In a groundbreaking legal case, NV Energy has filed a lawsuit against data center developer Tract over two proposed campuses near Reno, Nevada, with the utility claiming that the company is attempting to shift costs to consumers. These data centers are projected to collectively consume over 2 gigawatts of power, which represents nearly one-third of NV Energy’s total generating capacity.
This lawsuit is significant as it’s the first instance where a major utility has sued a data center developer, potentially setting a precedent for how costs associated with infrastructure for AI data centers are allocated. NV Energy contends that Tract’s push for private arbitration seeks to bypass public oversight regarding the power demands and financial responsibilities for the necessary infrastructure upgrades.
The utility argues that only state regulators can make decisions on these matters, as they will have a direct impact on all ratepayers. In contrast, Tract claims that NV Energy is failing to supply the promised power while still insisting on a $1 billion investment for grid improvements.
