In 2013, Marianne Karth suffered an unimaginable loss when a crash with a tractor-trailer took the lives of her two children, AnnaLeah and Mary. Since that tragic day, she has dedicated herself to preventing similar disasters for other families.

“The grief fuels the advocacy,” Karth shared with WRAL Investigates, stressing her belief that change is possible. The accident involved an “underride” crash, where Karth’s vehicle went underneath a tractor-trailer. To combat this issue, she has been campaigning for stronger rear guards and protective barriers for big rigs.

Recent Developments

Earlier this month, Karth achieved a significant milestone. For the first time, officials from the National Highway Traffic Safety Administration (NHTSA) attended tests of a new guard designed by local engineer Aaron Keifer. Karth expressed hope that these tests would prompt NHTSA to take action.

While NHTSA officials, including Deputy Administrator Lee White, expressed a desire to learn more, they did not commit to any immediate action. White mentioned, “There is a process we go through.”

Innovative Solutions

Keifer, a North Carolina State University graduate, developed the “safety skirt,” designed to prevent underride crashes. This $2,000 device works like a seatbelt surrounding the trailer wheels, creating a barrier that effectively prevents vehicles from going underneath.

Despite the requirement for rear underride guards since 1998, Keifer believes existing standards are insufficient. His dedication stems from his profession as a crash analyst.

Legislative Challenges

Support for underride protection has garnered attention from Congresswomen Valerie Foushee and Deborah Ross. Unfortunately, Ross’s bill to compel NHTSA to mandate underride guards is currently stalled in committee, reflecting frustrations with the legislative process.

“This is the least productive Congress we’ve had in probably 70 years,” lamented Ross. Meanwhile, Foushee noted, “The majority is holding it up,” expressing urgency to deliver results for the American people.

Industry Opposition

Critics of proposed underride protections cite costs and effectiveness concerns. The American Trucking Associations highlighted potential issues with side underride guards and warned that implementing such measures could divert resources from other, potentially more effective safety technologies.

Despite opposition, advocates like Jennifer Tierney, whose father died in a similar crash, emphasize the proven effectiveness of these devices. “If you knew that was going to be your loved one, would you want to pass the bill? Yes, you would,” she argued.
