Reese’s modifies pumpkin candy packaging after legal dispute

Hershey has added a disclaimer to its Reese’s Peanut Butter Pumpkins following a legal dispute regarding packaging claims. The new label states “Carving not on actual product” next to a decorated image of the candy, replacing the previous message that suggested the designs were merely decorative. This change comes after the dismissal of a proposed class-action lawsuit by two Florida consumers who claimed they were misled into expecting decorative carvings on the actual candy.

U.S. District Judge Melissa Damian ruled that the plaintiffs lacked legal standing, noting that their only injury was subjective disappointment rather than any defect or economic loss tied to the product. The plaintiffs expressed disappointment with the ruling and plan to appeal, emphasizing the importance of consumer expectations.

Hershey has recently introduced over 20 Halloween-themed products, as the holiday approaches.
