Initiated in 2021, the lawsuit involved 18 Native American tribes and contended that the state failed to uphold its constitutional mandate under the Indian Education for All initiative. This mandate requires all public school students to learn about the history and culture of Indigenous tribes in Montana.
The lawsuit emphasized a long-standing requirement in Montana’s constitution dating back to 1972. Following the decision to settle, rather than prolong the legal battle, officials are optimistic about moving forward to ensure that students receive an authentic education regarding Montana’s tribal nations. The settlement is currently awaiting final approval before implementation.
