NHTSA Launches Investigation into Safety Assertions of Tesla Cybercab

Tesla’s self-certification of its Cybercab as a fully driverless vehicle is raising concerns about the adequacy of the US autonomous vehicle compliance framework. The National Highway Traffic Safety Administration (NHTSA) has initiated an investigation into Tesla’s claims following the Cybercab’s commercial launch in Austin, Texas. This inquiry will assess whether Tesla’s compliance approach meets federal safety standards, especially given that the Cybercab operates without traditional driving controls.

  1. Self-Certification vs. Exemptions:

    • Tesla has opted for the standard self-certification process rather than pursuing a more tailored exemption like the one Zoox obtained through Part 555. This choice may expose Tesla to increased regulatory scrutiny and potential legal repercussions if the investigation identifies shortcomings.

    • The reliance on remote operators to manage the vehicles during system failures raises questions about Tesla’s portrayal of its service as completely driverless. Regulators may closely examine this discrepancy.
