In a recent case in Florida, a woman named Melissa Payne shot and killed 62-year-old Army veteran Bart Diguglielmo during a dispute over a parking space at Walmart. The shooting incident occurred on June 30, and after reviewing evidence, including security footage and police recordings, prosecutors determined that Payne would not face charges due to Florida’s “Stand Your Ground” law.
The law allows individuals to use deadly force without retreating if they believe they face an imminent threat of death or serious harm. In this case, the investigation revealed that Diguglielmo, who was unarmed, had approached Payne’s vehicle multiple times during the argument about the parking space.
Assistant State Attorney Stephen Zaccor noted that prosecutors could not meet the standard of “clear and convincing evidence” required to prove that Payne’s use of force was not justifiable. Payne claimed that Diguglielmo had threatened to damage her vehicle and was warned to back away before she fired. Following the shooting, she was initially arrested but later released.
The decision not to charge Payne has sparked criticism, particularly from Diguglielmo’s family, who expressed disappointment, arguing that the threat to property does not justify the use of deadly force.
