Legislators urge state Supreme Court to prolong deadline for skill games.

Summary of Recent Legislative Developments Regarding Skill Games in Pennsylvania

On October 6, State Senator Gene Yaw (R-Lycoming) participated in a rally advocating for the legalization and taxation of skill games, alongside business owners and volunteer organizations. Four state lawmakers, including Yaw and Senator Anthony Williams (D-Philadelphia), have requested the Pennsylvania Supreme Court to extend a stay on a ruling that declared these devices as illegal gambling machines.

The initial ruling, issued on June 15, determined that skill games fall under the state’s Gaming Act, necessitating that operators be licensed by the state Gaming Control Board. In light of this ruling, law enforcement has been instructed not to act on the decision for a 120-day safe harbor period, which ends on October 13. The legislators are seeking an extension until February 10 to allow more time for the General Assembly to create regulatory legislation.

Various types of skill games, often found in locations such as corner stores and bars, have become increasingly popular in Pennsylvania. The Georgia-based company Pace-O-Matic, known for its skill game software, contends that their machines are distinct from traditional slot machines, as players have the chance to win back their bets.

Despite legislation advancing through both chambers, lawmakers highlight the need for further consensus before the upcoming deadline. The proposal includes a $500 monthly fee per game, anticipated to generate $300 million in state revenue. In contrast, the commonwealth’s casino industry, which strongly opposes skill games, is taxed at a significantly higher rate of 55%.

Senator Yaw expressed his resilience, urging leadership to bring his bill to a vote, confident it would succeed. As the legislative session nears its end, the petition to the Supreme Court emphasizes the urgency of granting an extension to facilitate a smoother implementation of any new legislation.
