Virginia Targets Data Center Expansion and Energy Consumption

Virginia is actively addressing the rapid growth of data centers due to concerns about their impacts on electricity costs, water resources, land use, and local communities. Governor Abigail Spanberger recently unveiled the Data Center Accountability Framework along with Executive Order 22, which aim to reform how data centers are developed and deployed in the state.

Key Aspects of the Framework

  1. Approval Process:

    • Data centers will face new rules concerning their approval process, including stronger community involvement.
    • Facilities that use over 25 megawatts of power will require local approval instead of being fast-tracked.
  2. Infrastructure and Costs:

    • Increased financial commitments from developers at earlier stages to prevent prolonged land and resource conflicts.
    • Utilities must fairly allocate electricity transmission and generation costs to large consumers like data centers.
  3. Environmental Standards:

    • New regulations concerning energy and water consumption, emissions, and noise levels.
    • Facilities are encouraged to invest in cleaner energy options and will only receive priority for grid access if they demonstrate sustainable practices.
  4. Community Engagement:

    • The plan eliminates non-disclosure agreements for commercial projects, enhancing transparency.
    • It provides local governments with tools to negotiate with developers and ensures that community concerns are addressed.
  5. Local Economic Impact:

    • Prioritization of local hiring and contractor opportunities for Virginia businesses.
    • Promotion of sustainable materials and practices in construction.
  6. AI and Data Centers:

    • Establishment of an AI Task Force to tackle challenges related to AI development, focusing on workforce impacts, privacy, and cybersecurity.

Next Steps

Some immediate changes are underway through Executive Order 22, while other elements will require legislative approval in the upcoming session. The focus is on establishing a structured approach to managing the intersection of data center growth, utility demands, local communities, and environmental stewardship.

In the broader context, Virginia is not alone in facing these challenges; states like New York and Florida are also implementing measures to manage data center growth responsibly.
