Abbott Laboratories is facing claims that it misrepresents the health benefits of its Ensure nutrition drinks, which allegedly contain high sugar levels. The plaintiffs argue that the drinks, marketed as providing “Complete, Balanced Nutrition for everyday health,” are misleading, given that scientific evidence suggests high sugar consumption negatively impacts health.

LeGrand and Bates seek to represent both a nationwide class and subclasses in New York and California for consumers who purchased Ensure drinks for personal or household use. They accuse Abbott of unjust enrichment and misrepresentation, violating both New York General Business Law and California’s Consumers Legal Remedies Act.

They are requesting a jury trial and seek declaratory and injunctive relief, along with compensatory and punitive damages for themselves and class members.

This lawsuit follows an acknowledgment by the U.S. Food and Drug Administration regarding issues in its response to a baby formula shortage linked to Abbott.
