The diversion program, approved by the courts, allows Pass to avoid jail time and a formal conviction, offering him supervision and mandated community service instead.

Despite this defense, North Providence Mayor Charles Lombardi voiced concern, stating that one offense should warrant accountability.
“Being a law-abiding citizen does not justify such actions,” Lombardi asserted.
Ruggiero emphasized that the court’s conclusion in this case motivated him to share the surveillance footage with the public.
“We felt strongly about the charges we made against Mr. Pass,” he noted.
According to police accounts, the incident began when the victim was cleaning gym equipment, mistakenly assuming it was unoccupied, leading to a verbal confrontation. The victim reportedly sustained injuries to his back during the fall.
