New Jersey Legislation Bans Restaurants from Automatically Providing Plastic Utensils • YeahThatsKosher

The newly implemented “Skip the Stuff” law in New Jersey, effective August 1, 2026, significantly changes how utensils and condiments are provided with food orders. Restaurants and food service businesses are now required to give single-use items like plastic forks, napkins, and condiment packets only upon customer request, aimed at reducing plastic waste.

Key Changes:

  • Takeout and Delivery: Customers must actively request utensils and condiments with their orders, whether placed in-person or online, including through apps like DoorDash and Uber Eats.
  • Dine-In Rules: Full-service restaurants must provide reusable utensils for meals consumed on-site, while smaller establishments may see the most significant changes due to the discontinuation of automatic disposable cutlery.
  • Self-Serve Stations: These will still operate but must offer individual items instead of bundled packages. By August 1, 2027, all bundled items will be entirely prohibited.

Exemptions:

Certain facilities, such as schools and healthcare institutions, are not subject to these new regulations. Meanwhile, food court vendors have until 2028 to comply.

Penalties for Non-Compliance:

If businesses fail to adhere to the law, they can face fines ranging from warnings for first violations to $250 for repeated offenses within a year.
