M6 driver stated that a child vomiting was ‘a medical emergency’

Summary of the Case:

Lucifer Morningstar, age 28, faced a trial at Carlisle’s Rickergate court for allegedly speeding at 59 mph in a 40 mph zone near roadworks while driving to Birmingham with his family. He claimed he was under duress due to a medical emergency: his partner was suffering from a flare-up of her condition, and his four-year-old stepdaughter was vomiting and later choking.

Despite confirming he was driving, he denied the charge, stating he was unaware of exceeding the speed limit due to the chaotic situation in the car. The prosecutor noted he sought a speeding awareness course instead of accepting a fixed penalty notice, mentioning he couldn’t afford the fine.

Judge Philip Holden pointed out that for a duress defense to be valid, the defendant must believe that serious injury or death would occur if they acted differently. While acknowledging the stressful situation, the judge concluded that Morningstar’s actions did not demonstrate a genuine medical emergency that warranted his speeding. Ultimately, he ruled that the true reason for the speeding was not recognizing the speed limit signs, resulting in a penalty of four points on his license, a £120 fine, a £48 victim surcharge, and £200 in costs.
