Former Biote Employee Claims Sleep Supplement Caused Liver Damage

A former employee of a hormone therapy and supplements company in Irving has initiated legal action, claiming that a sleep supplement offered by the company resulted in severe liver damage for both him and his spouse.

Christopher and Mary Pat Sharon filed their lawsuit against Biote Medical on Monday evening in Dallas County court. The couple expressed concerns that others might also have suffered negative health impacts from the supplement.

As of Tuesday afternoon, the online court records did not indicate any official response from Biote. Representatives from the company had not responded to requests for comments by that time.

In their lawsuit, the Sharons state that they took Biote’s “Deep Sleep” supplement as instructed. They allege that starting around 2021, after using the product, both experienced symptoms indicating liver damage, necessitating medical consultations and a liver biopsy for Mary Pat Sharon.

In late 2021, according to the lawsuit filing, Biote ceased the production of the “Deep Sleep” supplement and introduced a reformulated version called “Best Night Sleep.” However, it is claimed that the company did not provide any notification to the public regarding the discontinuation of the original product. Christopher Sharon, who is not a doctor, did not immediately link the supplement to their health complications.

Over the next two years, Christopher Sharon grew increasingly concerned that the original formulation of the supplement might pose serious health risks, based on both his personal experience and feedback from other consumers.

By 2023, while still employed at Biote but having been let go since, Christopher Sharon raised his concerns internally, as outlined in the lawsuit.

Allegedly, the company did not adequately address or respond to his concerns.

According to the lawsuit, “Mr. Sharon became increasingly convinced that the reformulation of Deep Sleep was connected to the safety issues surrounding the original product.”

Christopher Sharon was officially terminated from Biote in mid-2025. His attorney, Bill Brewer, stated that the company attributed the termination to a restructuring effort.

Brewer explained that Christopher Sharon is pursuing legal action now, instead of before his termination, because he attempted to hold the company accountable internally without success.

“Mr. Sharon never felt he received a satisfactory explanation regarding… what the company was doing or whether it discontinued the Deep Sleep product in response to others experiencing similar problems to those he and his wife faced,” Brewer added.

The Brewer law firm has previously taken legal action against Biote.

The firm represented Biote’s founder, Gary Donovitz, in a lawsuit filed in 2022 against the company. In that case, Donovitz accused Biote of misleading him into agreeing to a merger deal to take the company public—an agreement he described as a “get-rich-quick scheme” that resulted in significant financial losses.

By 2024, Biote settled with Donovitz and also reached an agreement with his ex-wife, represented by the Brewer firm. The total settlements exceeded $130 million.
